The meltdown of the subprime mortgage lending industry has resulted in enhanced regulatory scrutiny and an onslaught of litigation against mortgage brokers and lenders. In reaction to the rise in foreclosures, we can expect to see new legislation and regulations which will create additional complexity and undoubtedly more litigation.
